1. Provider identification
This service is provided by APEX APP SpA, Tax ID 78.426.148-4, domiciled in Las Condes, Santiago, Chile, registered in the Registry of Companies with activities commenced before the Chilean Internal Revenue Service (SII). 2. Service description
APEX is an integrated personal tracking mobile application that centralizes four areas of your life: • Habits and skills: tracking of daily routines, frequencies, streaks and skill progress. • Fitness: logging of workouts, body measurements, fitness tests, nutrition and AI-generated training plans. • Finances: income and expense tracking, debt management, projections, bank statement import, and voluntary bank connection via Fintoc. • Tasks: daily task management. APEX integrates artificial intelligence across all its modules to generate personalized analysis, training plans and a monthly comprehensive progress report (APEX Full).
3. Acceptance of terms
By downloading, registering or using APEX, you accept these Terms & Conditions in full. If you disagree with any part, you must refrain from using the service. These terms are governed by Chilean law, in particular Law No. 19,496 on the Protection of Consumer Rights and its amendments.
4. Registration and account
To use APEX you must create an account with a valid email address and a secure password, or through Google authentication. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. APEX is not directed at persons under 18 years of age. By registering, you declare that you are of legal age under Chilean law. If we detect that a minor has created an account, we will delete it immediately.
5. Plans and pricing
APEX operates under a freemium model with four plans: • Free: $0 — permanently available, no credit card required. • APEX Health: $3.99 USD/month · $29.99 USD/year (approx. 37% savings). Includes fitness, habits and health AI. • APEX Finance: $3.99 USD/month · $29.99 USD/year (approx. 37% savings). Includes advanced finances, Fintoc and AI analysis. • APEX Full: $6.99 USD/month · $49.99 USD/year (approx. 40% savings). Includes everything in Health + Finance plus a monthly AI Life Coach and cross-analysis. Prices are expressed in U.S. dollars (USD) and include applicable taxes where required by law. The full breakdown of features per plan is available at useapexapp.com/precios. APEX reserves the right to modify prices with a minimum of 30 days' notice to active users. Changes do not affect periods already paid.
6. Freemium model
The Free plan is permanently available with no time limit and no credit card required. There is no trial period for paid plans nor any automatic charge associated with using the free plan. Activating a paid plan is always voluntary and explicit. The features included in each plan may be updated with prior notice; if a change reduces the features of your active plan, you have the right to cancel without penalty.
7. Billing and payment processing
Subscriptions purchased through the website useapexapp.com are processed by Dodo Payments, a global Merchant of Record that handles taxes and international payments. By subscribing via the web you authorize recurring billing for the selected period (monthly or annual). APEX does not store credit or debit card data. The processing and security of payment data are the sole responsibility of the payment provider under its own terms and privacy policy. Subscriptions renew automatically at the end of each period unless canceled before the renewal date.
8. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you retain access to the service until that date. There are no cancellation penalties. Cancellation methods by purchase channel: • Web subscription: from your account settings in the app (Profile → Settings → Subscription) or by writing to support@useapexapp.com. • App Store subscription (iOS): App Store → your profile photo → Subscriptions → APEX → Cancel subscription. • Google Play subscription (Android): Google Play → Profile → Payments and subscriptions → Subscriptions → APEX → Cancel.
9. Refund policy
For subscriptions purchased via web: APEX will evaluate refund requests for serious technical problems or unresolved billing errors within a maximum of 5 business days. To request one, write to support@useapexapp.com with proof of payment and a description of the problem. For subscriptions purchased via App Store or Google Play, refunds are governed by Apple's and Google's policies respectively: • Apple: reportaproblem.apple.com (up to 90 days from purchase). • Google: Google Play Store (up to 48 hours from purchase for an immediate refund). APEX has no access to payment data and cannot directly manage refunds for purchases made in app stores.
10. Acceptable use
By using APEX you agree to: • Provide truthful information in your profile and records. • Not attempt to access other users' data or breach the security of the system. • Not use the application for illegal purposes or purposes contrary to good faith. • Not reverse engineer, decompile or attempt to extract the source code of the app. • Not automate access to the app or its APIs without express written authorization. • Not resell or sublicense access to the service. APEX reserves the right to suspend or delete accounts that violate these conditions, without refund, with prior notice where applicable.
11. Artificial intelligence
APEX uses artificial intelligence models from Anthropic PBC (Claude models) to generate personalized analysis, training plans, habit suggestions, food logging and the monthly comprehensive progress report. These analyses are indicative and do not constitute medical, nutritional, financial or any other regulated professional advice. AI-generated content may contain errors or inaccuracies. You must exercise your own judgment and consult qualified professionals before making important decisions about your health or finances based on APEX analysis.
12. Bank connection (Fintoc)
APEX optionally offers the ability to connect your bank account through Fintoc Technologies to automatically import your financial transactions. This connection is entirely voluntary and you may revoke it at any time from the app. By using this feature you authorize Fintoc to access your banking information in read-only mode, under its own terms of service and privacy policy. APEX only receives the transaction data necessary for financial tracking and does not store your banking credentials under any circumstances.
13. Intellectual property
All rights to the APEX application, including design, source code, brand, logos, text and content created by the APEX APP SpA team, are the exclusive property of APEX APP SpA or its licensors and are protected by Chile's Law No. 17,336 on Intellectual Property and applicable international treaties. The data and content you enter into the app (records, notes, personal information) are your property. APEX claims no rights over your personal data.
14. Limitation of liability
APEX is provided "as is" and "as available." To the extent permitted by applicable Chilean law: • APEX does not guarantee uninterrupted service availability (interruptions may occur due to maintenance or causes beyond our control). • APEX is not responsible for data loss caused by failures of third-party cloud or connection providers. • APEX APP SpA's total liability for any claim shall not exceed the amount paid by the user in the last 12 months of subscription. No provision of these terms limits non-waivable consumer rights recognized by Law No. 19,496.
15. Changes to the service and these terms
APEX may update these terms or modify the service. Material changes will be notified at least 30 days in advance by email or in-app notification. If a change harms you, you have the right to cancel your subscription before the effective date without penalty. Continued use of the service after notification implies acceptance of the updated terms.
16. Termination of service
APEX reserves the right to discontinue the service with a minimum of 30 days' notice by email. In the event of a permanent shutdown, users with an active subscription will receive a refund proportional to the unused period. You may delete your account and all your data at any time from Profile → Settings → Delete account. After confirmation, the data is permanently and irreversibly deleted within a maximum of 30 days.
17. Applicable law and dispute resolution
These terms are governed by the laws of the Republic of Chile. Any dispute that cannot be resolved by mutual agreement between the parties will first be submitted to mediation before SERNAC or the competent consumer protection bodies. If no agreement is reached, the dispute will be resolved before the ordinary courts of justice of Santiago, Chile.

These terms are governed by the laws in force in the Republic of Chile, in particular Law No. 19,496 on the Protection of Consumer Rights, Law No. 17,336 on Intellectual Property, and their respective amendments.
